1. Petitioner is a defaulting borrower of a working capital term loan for a sum of Rs.6.6 lakhs, which was classified as on 31st March,2014 on account of financial indiscipline.
2. The present petition has been filed challenging the demand notice dated 15th September,2022 issued under Section 13(2) of the SARFAESI Act, 2002, whereby the outstanding liability of Rs.5,17,005.11 due as on 31st March,2014 along with future interest, expenses etc. have been recalled.
3. At the time of hearing, Mr. Swain, learned counsel for the Bank submits that as on today a sum of around Rs.17.00 lakhs would be due, and further states that the writ petition would not be maintainable simplicitor against the aforesaid demand notice.
// 2 // At this stage, the learned counsel for the petitioner prays for permission to withdraw the writ petition to enable his client to file his objection to the aforesaid demand notice.
Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty.
