This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State.

It is submitted by the learned counsel for the Petitioner that Charge Sheet has not been filed within the stipulated period of 120 days as provided in the Statute. It is further submitted by the leaned counsel for the Petitioner that one of the co-accused persons namely Pritam Manohar Pardeshi and others have been enlarged on bail under sections 167(2) Cr.P.C. by this Court in CRLMC No.552 of 2021.

Considering such submissions, the Petitioner is given liberty to approach the Court in seisin over the matter by filing an application under section 167 (2) Cr.P.C. In the event such an application is filed, the same shall be considered in accordance with law and in the light of the order passed by this Court in CRLMC No.552 of 2021 and dispose of the Petition of the Petitioner as expeditiously as possible

// 2 // preferably within a period of two weeks from the date of filing application. LC.R. and Case Diary be made available. 5.

With the aforesaid observation, the BLAPL stands disposed of. 6.

Issue urgent certified copy as per Rules.
