This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. for grant of bail to the petitioner in connection with Pipili P.S. Case No.13 of 2020 corresponding to G.R. Case No. 22 of 2020 pending in the Court of learned J.M.F.C., Pipili, Puri for alleged commission of offences under section 395 of the Indian Penal Code and sections 25 and 27 of the Arms Act.
Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 11.02.2020 and his earlier bail application was
// 2 // rejected mainly on the ground that he has been identified in the test identification parade. However, liberty was granted to renew the prayer for bail after examination of the identifying witnesses.
A status report was called for from the learned Court below as per order dated 17.03.2022 and the learned Court below has furnished its report dated 23.03.2022, from which it reveals that the case has not yet been committed to the Court of Sessions. Considering the submissions made by the learned counsel for the respective parties, the delay in commencement of the trial, while not inclining to release the petitioner on bail on merit, I am inclined to release the petitioner on interim bail for a period of three months from the date of release. The petitioner shall surrender before the learned trial Court immediately on expiry of the three months period. For the above period, let the petitioner be released on interim bail in the aforesaid case on furnishing bail bond of Rs.
// 3 // 10.00 p.m. to 4.00 p.m. and he shall not indulge in any criminal activities;
Violation of any of the terms and conditions shall entail cancellation of interim bail.
Accordingly, the BLAPL is disposed of.
