None appears for the Petitioner when the matter is called. Heard learned counsel for the State.

With the passage of time, the application has become infructuous as the Petitioner must have retired from service on attaining the age of superannuation. Thus the relief claimed in the petition cannot be granted. In such view of the matter, the writ petition stands dismissed as infructuous. However, liberty is granted to the Petitioner to move an application for restoration of the case in the event cause of action still survives.
