1. Heard the learned counsel for the Petitioner and the State.

2. By means of this application, the Petitioner seeks grant of bail U/s.438 Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 420/468/471/34, I.P.C. in connection with Subalaya P.S. Case No.78 of 2021 corresponding to G.R. Case No.325 of 2021 pending in the court of learned S.D.J.M., Birmaharajpur.

3. Learned counsel for the Petitioner submits that, arising out of the present case, co-accused Hrusikesh Karmi has since been released on bail by this Court vide order dated 30.09.2021 passed in ABLAPL No.9809 of 2021, and the present Petitioner being in the same footing with the said co-accused Hrusikesh Karmi, may be considered for bail.

4. Keeping in view the aforesaid submission and having gone through the nature of allegations as emerged from the materials on

// 2 // record, and further the circumstances appearing, the seriousness and gravity of the offences, though this court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioner surrenders and moves for bail before the learned S.D.J.M., Birmaharajpur in the aforesaid G.R. Case within a period of three weeks from today, he shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court to ensure his presence before the I.O as well as in the court.

5. The ABLAPL is disposed of accordingly.
