This matter is taken up through hybrid mode.

The writ petition has been registered before this Court on 8th December, 2021, after the original application was transferred from the learned Orissa Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition.

On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was not taken up for admission when listed on 04.03.2014 and 04.07.2014 and was never taken up thereafter.

The original application was filed in the year 2013 by the petitioner/applicant who was aged about 74 years, inter alia claiming family pension challenging the order dated 01.10.1996 (Annexure-3 series) that came to the notice of applicant pursuant to the R.T.I. application which was responded by letter dated 08.08.2012.

It is submitted by the learned Standing Counsel that the late husband of the petitioner did not make any claim during his life time for getting the benefit of regularization/engagement and/or retiral dues for the post of Homeopathic Medical Officer.

It is submitted by the learned counsel for the petitioner that he has no up-to-date instruction from the petitioner to pursue the litigation at present and long pendency of the matter has not helped.

Having heard learned counsel for the parties, the writ petition is disposed of for lack of instructions from the petitioner granting liberty to revive the same within sixty days for any surviving cause of action.
