1. The matter is taken up through hybrid mode.
2. The present petitioner prays for direction to opposite party No.1 for deciding the re-fixation of his pay in the scale of Rs.840-16.... Rs.1240/- notionally, to remove the anomaly in the scale of pay as per the ORSP Rules, 1985. The anomaly arose due to the differential pay scale between the trained metric and non-metric trained Assistant Teacher of Primary School basing on the principle of equal pay for equal work as per the Resolution No.12750/E, dated 13.03.1992 of the State Government. The said principle has also been expounded in the case of N.C. Ray and another vrs. State and others in OJC No.2102/1983 decided on 12.05.1989.
3. Since the case was filed in the year, 2013, the cause of action must have been extinguished. The writ petition is disposed of as infructuous, due to efflux of time.
