The Original Application No. T-35 of 2013 was filed before the Odisha Administrative Tribunal, Bhubaneswar Bench, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (T) No. 35 of 2013.

The petitioner prays for direction to the opposite party no.1, namely, the Commissioner-cum-Secretary, Department of School and Mass Education, Govt. of Orissa for which of re-fixation of his pay notionally to remove discrimination in the scale of pay as per Orissa Revisied Scale of Pay Rules, 1985 between Trained Matric and non-Matric Trained Assistant Teachers of primary schools.

At the last occasion when the matter was listed on 28th February, 2022 none has appeared for the petitioner. Today when the matter was called, again there is non-appearance on behalf of the petitioner.

This matter relates to 2013 and keeping this matter pending may not be fruitful. In such view of the aforesaid

// 2 // matter, it is construed that the petitioner is no more interested to pursue the matter any further.

In view of the same, the Writ Petition stands dismissed.
