The Petitioner has filed the aforesaid petition seeking for the following reliefs:- "i) For re-fixation of the pay of the applicant in the scale of pay Rs.840/- 16........ 1240/- as per ORSP Rules, 1985 w.e.f. 01.01.1986. and re-fixation of he pay in subsequent revised scale of pay from time to time till his retirement on 31.01.1996.

ii) To Pay the last 3 years arrear dues arises by the Re-fixation of his pay w.e.f. 01.01.1986 as per ORSP Rules, 1985 till his retirement and in pensionary benefits w.e.f. 01.02.1996 by a date to be fixed by this Hon'ble Tribunal.

iii) To pay the revised rate of pension and pensionary benefits likes leave salary and gratuity amount due to re-fixation of pay w.e.f. 01.01.1986 till retirement from time to time to the applicant and iv) To pass any other orders deemed suitable and proper by the Hon'ble Tribunal to provide complete relief to the applicant and to meet ends of justice equity and fairness."

Mr. R.N. Acharaya, Standing Counsel for the School and Mass Education vehemently objected for grant of relief as prayed for. He urged that the Petitioner has claimed for re-fixation of the pay till his retirement on 31st January, 1996 which is hopelessly barred by limitation as the Petitioner has come up in the year 2013. 3.

On 28th February, 2022 none appeared for the Petitioner. Today also none appeared on behalf of the petitioner. Therefore, it is construed that the Petitioner is not interested to pursue the matter any further.
