2. Heard learned counsel for the petitioner and Mr. R.N. Mishra, learned A.G.A

3. The Petitioner has filed the present writ petition with the following prayer.

(i) To quash/modify the impugned part of the order dated 19.8.2013 relating to sanction of E.O.L (ii) To sanction the leave from 1.7.2010 to 1.8.2010 as E.L. instead of E.O.L and consequent endorsement on that count as narrated above.

It is submitted that though the petitioner had leave in his account, but while passing the order on 19.8.2013 under Annexure-3, the said period has been treated as Extra Ordinary Leave . Ms. Dash, learned counsel for the petitioner submitted that since during the period 1.7.2010 to1.8.2010, the petitioner had leave in his account, the said period should have been treated as Earned Leave instead of Extra Ordinary Leave. Since the petitioner has approached

// 2 // Opp. party No.1 in that light under Annexure-4, this Court while disposing the writ petition directs Opp. Party No.1 to take a lawful decision on the same within a period of two months from the date of receipt of this order and communicate the result thereof to the petitioner within that time. The order be provided to Opp. party No.1 by the petitioner within a period of seven days from the date of receipt of this order.
