The Original Application No. 307(C) of 2013 was filed before the Odisha Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 307 of 2013.

The petitioner, Associate Professor, Anaesthesiology, being aggrieved by non-consideration of his case for promotion to the post of Professor as there were absence of PAR/CCR for the periods 2004-05 to 2007-08 and 2002-03 filed the Original Application which subsequently is renumbered as WPC(OAC) No.307 of 2013 being transferred to this Court.

It is claimed that though out of two adverse remarks, one had already been expunged and the other is pending consideration before the opposite party no.1, namely, Chief Secretary, Government of Odisha who represents Selection Board (Departmental Promotion Committee for promotion to the post of Professor), his case could not be ignored.

Mr. P. K. Mohanty, learned Additional Standing Counsel submitted that the Writ Petition has been rendered infructuous in view of the fact that during the pendency of the Writ Petition, the petitioner has already been retired on attaining the age of superannuation, 5.

In view of such submission, the Writ Petition stands dismissed as infructuous.
