This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner and learned counsel for the State.

This is an application for bail under section 439 of Cr.P.C. in connection with G.R. Case No.712 of 2022 arising out of Kamakhyanagar P.S. Case No.379 of 2022 pending in the Court of learned S.D.J.M., Kamakhyanagar for offences punishable under sections 294/341/323/326/ 307/34 of the Indian Penal Code.

Perused the report submitted by the learned Sessions Judge, Dhenkanal dated 21.12.2022 from which it appears that one Remand Advocate was appointed by the learned S.D.J.M., Kamakhyanagar for the petitioner and the bail application filed by the petitioner was

// 2 // rejected but thereafter, the petitioner has not approached the learned Sessions Judge, Dhenkanal for bail.

Let a copy of the F.I.R. and other police papers, which are available in the case record be supplied to the petitioner in jail in order to enable him to move an application for bail in the Court of Session and if the petitioner desires to engage any Advocate of his choice, he may do so and the learned Sessions Judge shall ensure that there is no hindrance in moving the application for bail. In case, the petitioner expresses his inability to move the application for bail before the Court of Session by engaging an Advocate on his own and seeks the help of an Advocate from the Legal Aid Panel, the same shall be provided to him by the learned Sessions Judge, Dhenkanal.

With the aforesaid observation, the bail application is disposed of.

A copy of the order be forwarded to the learned S.D.J.M., Kamakhyanagar which will be handed over to the petitioner along with the documents as already ordered. The learned S.D.J.M. shall apprise the learned Sessions Judge about this order.

Issue urgent certified copy as per Rules.
