This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

None appears for the Petitioner when the matter is called. Heard learned counsel for the School and Mass Education Department.

Challenging the impugned advertisement under Annexure-8, the present writ petition has been filed. Petitioner has further prayed for a direction to regularize the services of the Petitioner in the post of Trained Graduate Teacher and consequently allow the pay attached to the said post with effect from 15.07.2008. 4.

Mr. Mohapatra, learned counsel for the School and Mass Education Department submits that the advertisement impugned herein is of the year 2010, therefore the matter has become infructuous, as the relief sought for in the writ petition cannot be granted now. He further submits that he has no objection if the Petitioner files a fresh representation to the Authority claiming his

// 2 // grievance therein. In such event, the Authority shall consider his grievance in accordance with law.

In such view of the matter, the present writ petition is disposed of with a direction to the Petitioner to file a fresh representation before the Director of Secondary Education, Odisha, Bhubaneswar, Opposite Party No.3, within a period of two weeks from today along with certified copy of this order. In such event, the Authority shall consider and dispose of the same in accordance with law by passing a speaking and reasoned order within a period of ten weeks thereafter. Decision thereto shall be communicated to the Petitioner within a period of ten days.

With the above direction, the writ petition stands disposed of.

Issue urgent certified copy as per rules.
