1. Heard learned counsel for the Petitioner and the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in anticipation of arrest for her alleged involvement in the offences U/s.294/323/307/324/379/506/34 IPC.

3. It is submitted by learned counsel for the Petitioner that the FIR speaks no direct overt act in respect to the present Petitioner. The co-accused being a woman has since been released on bail by this Court and the present Petitioner is also a woman and there being no direct allegation against her.

4. Keeping in view the submission of the parties, the nature of allegations, the circumstances appearing, the seriousness, gravity of the offences and the matter has since been settled between the parties, while this Court is not inclined to grant anticipatory bail, it

// 2 // is directed that in the event the Petitioner surrenders in connection with Jaleswar P.S. Case No.353 of 2022 corresponding to C.T. Case No.397 of 2022 pending in the court of learned J.M.F.C., Jaleswar within a period of two weeks' hence and moves for bail, she shall be released on such terms and conditions as would be deemed just and proper by the said court with further conditions that she shall appear in person before the court below on each date of posting of the case unless specifically exempted by the court concerned.
