Heard Mr. J.K. Khuntia, learned counsel for the petitioner and Mr. S. Jena, learned Standing Counsel for School & Mass Education Department.

The petitioner has filed this writ petition seeking to quash the order of the Collector, Kendrapara and B.D.O. Marshaghai vide Annexure-2 and to direct opposite party no.3 to disburse the entire salary in his favour.

Mr. Jena, learned Standing Counsel for School & Mass Education Department received the instruction from the Block Education Officer, on 27.10.2022, wherein at paragrpahs-3, 4 and 5 it has been stated as follows:- "3.

That, it is respectfully stated that the marriage between Shri Anjan Kumar Parida and Smt. Lamipriya Parida is dissolved and Decree of Divorce is drawn vide judgment dated 10.01.2018 passed in Civil Proceeding No. 776 of 2012 (CP No. 298/2013) by the court of learned Family Court, Kendrapara and Smt. Laxmipriya Parida had received Rs.5,00,000/- (Rupees five lakh) only as permanent alimony.(copy enclosed) 4.

That, it is also pertinent to mention here that on verification of records, it is ascertained that no amount was

deducted from the monthly salary account of Shri Parida till his retirement, i.e. 31.01.2022.

That, in view of the Decree of Divorce between Shri Anjan Kumar Parida and his wife Smt. Laxmipriya Parida and also the retirement of Shri Anjan Kumar Parida from Service, the above noted writ petition now become infructuous." 5.

In that view of the matter, on the basis of the above information supplied by the Block Education Officer, Marshaghai, this writ petition stands disposed of.
