It is submitted by Mr.K.K. Nayak, learned Standing Counsel for the State that Counter Affidavit has already been filed in this case. In the Counter Affidavit, it has been stated that Petitioner had failed in the physical test, pursuant to direction of the Orissa Administrative Tribunal, Cuttack Bench, Cuttack, therefore, the relief sought for in the Original Application cannot be granted. Accordingly, the writ petition being devoid of merits, the same is accordingly dismissed.
