Indumati Das v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.36177 of 2021 Indumati Das ....
Petitioner Mr. C. Pattnaik, Advocate -versusState of Odisha and others ....
Opposite Parties Mr. Ishwar Mohanty, A.S.C. for the State
CORAM:
THE CHIEF JUSTICE JUSTICE CHITTARANJAN DASH
ORDER
11.10.2022 Order No.
08.
1. After perusing the rejoinder and after hearing learned counsel for the Petitioner, the Court is not satisfied that this is a bona fide PIL. It appears that there is already a civil suit concerning the land in question in which some interim order has been passed by the civil court.
2. The Court does not, therefore, propose to entertain the present petition since the subject matter of the suit and the present petition seems to be identical.
3. As regards the main grievance, the stand of the State is that there is clear twenty feet road that provides an approach to the Anganwadi Centre construction of which has already been completed.
4. The Court is not willing therefore to entertain the present writ petition any longer and it is accordingly dismissed. (Dr. S. Muralidhar) Chief Justice (Chittaranjan Dash) Judge S.K. Guin
