Heard Mr. G. Namtoar, learned counsel for the Petitioner and Mr. N.N. Satapathy, learned Standing Counsel for the State-Opposite Parties.

On the oral prayer made by the learned counsel for the Petitioner he is permitted to implead Block Education Officer, Champua as Opposite Party No.3 in Court today.

It is submitted that the Petitioner's father while working as an Assistant Teacher in Sizuguda Primary School, he died on 27.11.2002.

It is submitted that since at the relevant of time, the Petitioner was a minor, he could not make any application for appointment under the provision of RACP scheme.

It is further submitted that on attaining the age of 18 years, when the Petitioner moved his application on
// 2 // 14.08.2016 under Annexure-2 that was not accepted by the Opposite Party No.3 6.
Since the application under Annexure-2 was made on attaining the age of 18 years, the same should have been accepted as the said claim is covered as per the provision contained under Rule-9(7) of OCS (RA) Rules, 1990.

Therefore, this Court while disposing the Writ Petition directs the Opposite Party No.3 to accept the application of the Petitioner and take appropriate steps in accordance with the relevant rule. The entire exercise shall be completed within a period of three months from the date of receipt of this order. 8.
