The matter is taken up through video conferencing mode. 2.
Heard Mr. A.k. Nath, learned counsel for the Petitioner and Mr. P.K. Mohanty, learned Additional Standing Counsel. 3.
This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner Sudra @ Sudarshan Naik in connection with Banarpal P.S. Case No.24 of 2007 corresponding to C.T. Case No.181 of 2007 pending in the court of learned J.M.F.C., Banarpal for alleged commission of offence under Sections 366-A/376 of the Indian Penal Code.

It is submitted that the Petitioner was earlier released on bail but in search of livelihood he defaulted in attending the trial court. Accordingly NBWA was issued and he was taken to custody on 27th October, 2021. It is further submitted that as per allegations, the Petitioner and victim were in love relationship.

Upon hearing Mr. Mohanty, learned Additional Standing Counsel and considering the period of detention of the Petitioner inside custody and that he was released on bail earlier, it is directed to release the Petitioner on bail in the aforesaid case on such terms and conditions to be fixed by the learned court in seisin over the matter including the condition that, the Petitioner shall furnish two sureties out of whom one shall be his relative and he shall attend the trial court on each date fixed.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, in the manner prescribed vide Court's Notice No.514 dated 7th January, 2022.
