The petitioners have filed this writ petition seeking direction to opposite parties to consider their case for promotion to Level-IV and then to Level-III retrospectively as against the vacancies of 2009 and to declare Rule11 (2) of Elementary Service Rules, 1997 inoperative on face of Right to Children to Free and Compulsory Education Act, 2009 and Orissa Rules, 2010, read with NCTE Notification dated 23.08.2010. 3.
In course of hearing, learned counsel for the petitioners states that the petitioners may be permitted to file a fresh representation before opposite party no.1 highlighting the grievances and direction may be given to consider the same within a stipulated time, to which learned counsel for the State has no objection.

As agreed to by learned counsel for the parties, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of with the direction that in case the petitioners, with regard to the grievance made in this petition, files a fresh comprehensive representation before opposite party no.1, within fifteen days hence, the said authority shall consider the same and pass a reasoned and speaking order, as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with the certified copy of this order. 5.
Issue urgent certified copy as per rules.
