Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties, more particularly opposite party No.3 to allow the petitioner the TGT Scale notionally from 23.11.1970 and to receive all his financial benefits with effect from 01.01.2006 in pursuance of his retirement from service on 30.06.2006. 4.

In course of hearing, learned counsel for the petitioner states that highlighting the grievance, the petitioner has made a representation to the opposite party no.3 vide Annexure-6 and direction may be given to consider and dispose of the same, taking into consideration the order passed by the Orissa Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No. 3824 (C) of 2012 decided on 10.02.2015 and the order dated 11.06.2020 passed in CONTC (CPC) No. 184 of 2015, within a stipulated time, to which learned Standing Counsel for S&ME Deptt has no objection. 5.

As agreed to by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes

of the writ petition directing the opposite party no.3 to take a decision on the representation filed by the petitioner vide Annexure-6, taking into consideration the order passed by the Orissa Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No. 3824 (C) of 2012 decided on 10.02.2015 and the order dated 11.06.2020 passed in CONTC (CPC) No. 184 of 2015 and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy of this order by the petitioner.
