This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode).
The petitioner Saroj Kumar Sahoo, has filed this writ petition for a direction to the Tahasildar, Athamallik (opposite party no.4) to grant permission and SubRegistrar, Athamallik (opposite party no. 5) for alienation of the land of the petitioner in Khata No.44/15 of MouzaTalaepathara, Tahasil-Athamallik, P.S. No.81, Dist-Angul.
// 2 // It is further submitted by the learned counsel for the petitioner that a representation has been submitted on 13.07.2022 before the Tahasildar, Athamallik (opposite party no.4) under Annexure-3 but no action has been taken thereon and the representation is still pending before the concerned authority and necessary direction may be issued to the opposite party no.4 to consider and dispose of the representation under Annexure-3 at an earliest after giving an opportunity of hearing to the petitioner.
Learned counsel for the State has no serious objection to the prayer made in this writ petition. Considering the submissions made by the learned counsel for the respective parties and in view of the limited nature of prayer, without expressing any opinion on the merits of the case, this Court directs the opposite party no.4 Tahasildar, Athamallik to consider the representation of the petitioner under Annexure-3 in accordance with law after giving opportunity of hearing to the petitioner and all concerned within a period of four weeks from the date of production of the copy of this order along with a copy of the writ petition, if the same has not been done in the meantime and the decision taken on the representation shall be communicated to the petitioner within two weeks from the date of taking the decision.
