It has been brought to the notice of this Court by the learned counsel for the Petitioners that pending consideration of the Writ Petition, the contesting Opposite Party has already preferred an OPLE Appeal bearing No.52/2021 pending on the file of the SubCollector, Bhadrak. It is for this development in the meantime, learned counsel for the Petitioners seeks targeting the said Appeal. 2.
In the circumstance, this Court in disposal of the Writ Petition directs the Appellate Authority in the event of initiation of OPLE Appeal bearing No.52/2021 to dispose of the same at least within three months subject to however the Petitioners as aggrieved parties appear with a copy of this order before the appellate authority within ten days. In that event, the said Appeal shall be decided in a lawful manner giving opportunity of hearing to the Parties likely to be affected.
