This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and the learned State counsel.

Being aggrieved by the order dated 17.12.2019 by which the NBW was issued against the petitioner in C.T. Case No.317 of 2013, arising out of Bhawanipatna Town P.S. Case No.81 of 2013, on the file of learned J.M.F.C., Bhawanipatna, the petitioner has approached this Court.

While prima facie, this Court does not find any infirmity in the order passed but in order to allow the petitioner to effectively defend himself, it is directed that, in the event, the petitioner surrenders within a period of three weeks hence, he shall be released on bail on earlier terms.

It is made clear that, in the event the petitioner do not surrender within the time fixed, it shall be open to the prosecution to take effective steps in terms of the impugned order 6.

The impugned order dated 17.12.2019 directing issuance of NBW is set aside.

While being released on bail, it is directed that the petitioner shall furnish his mobile number and email I.D., if any.

8.

The CRLMC accordingly stands disposed of.

9.

Urgent certified copy of this order be granted as per rule.
