This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Tirtol P.S. Case No.473 of 2021 corresponding to G.R. Case No.450 of 2021 pending in the Court of learned J.M.F.C., Tirtol for commission of the alleged offence punishable under sections 302/34 of the Indian Penal Code.
Perused the F.I.R. annexed to the anticipatory bail application.
It is a case under section 302 of the Indian
// 2 // Penal Code.
In view of the available materials on record and the nature and gravity of the accusation, while not inclining to grant anticipatory bail to the petitioner, it is observed that in the event the petitioner surrenders and moves for bail in the Court below within a period of four weeks from today, the same shall be disposed of by the learned Courts below in accordance with law expeditiously and proviso to section 437(1) of Cr.P.C. shall be taken into account. The case records shall be made available before the Courts concerned for adjudication of the bail application.
The ABLAPL stands disposed of.
