Heard Mr. S. Swain, learned Senior Panel Counsel, Govt. of India appearing for the Union of India-petitioners and Mr. D.P. Dhalasamanta, learned counsel for opposite parties no.1 and 2. 3.

On 19.10.2022, Mr. S. Swain, learned Senior Panel Counsel, Govt. of India appearing for the Union of Indiapetitioners produced the instructions received by him from the Superintendent Administration General, National Library, Kolkata on 19th October, 2022 to the following effect:- "In view of the above, we have started the process for releasing family pension with gratuity etc. in favour of Smt. Ashalata Das, W/o Late Ramakanta Das, Ex. MTS, National Library from getting direction from MoC, Culture, New Delhi in the above matter i.e. W.P.(c) No. 37081 of 2020 (Union of India and others Vrs. Ashalata Das and others)." 4.

In view of the above instructions received, this Court, on 19.10.2022, granted one month time to the Union of IndiaPetitioners to extend the benefit of family pension to the opposite parties. In compliance of the said order, today Mr. S. Swain, learned Senior Panel Counsel, Govt. of India appearing for the Union of India-petitioners, on instructions received by him, stated that for extension of benefit of family pension certain procedures has to be followed and, as such, the petitioners are working on the

same with the assistance of the opposite parties so that the benefit can be extended as soon as possible.

In such view of the matter, this writ petition stands disposed of directing the Union of India-petitioners to extend the benefit of family pension to the opposite parties, as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order by the opposite parties, subject to compliance of requirement as per Rules. Issue urgent certified copy as per rules.
