1. The learned counsel for the Petitioner submits that the fact in Order No.

issue alleged in this writ petition is same and similar to the fact in issue as well the relief claimed in the disposed of W.P.C (OAC) No.1430 of 2017.

2. The learned counsel for the State too subscribes the view as the one submitted by the learned counsel for the Petitioner. Perused the Petition in the present as well as the one in the disposed of Writ Petition. Considering the same to be the same and similar and this court having advert to a different view then the one taken in W.P.C (OAC) No. No.1430 of 2017 the present petition this Court can consider the same in the light of the order passed in W.P.C (OAC) No.1430 of 2017.
