Sk. Ansuddin v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.C(OAC) No.4130 of 2011 Sk. Ansuddin ....
Petitioner Mr.P.K.Khuntia,, Adv.
-versusState of Odisha & Ors.
....
Opposite Parties Mr.Karunakar Das, ASC
CORAM:
MR. JUSTICE S.K. PANIGRAHI
ORDER
15.02.2022 Order No.
01.
1. This matter is taken up by hybrid mode.
2. Learned counsel for the petitioner submits that the petitioner approached before the Tribunal in the year 2011 challenging the illegal action/inaction of the opposite parties, specifically, the opposite party No.2's inaction for issuance of admit card in favour of the petitioner for written test which was scheduled to be held on 08.11.2011. But by efflux of time the WPC(OAC) has lost its relevance and cause of action raised therein does not seem to be surviving. Hence, the writ petition has become infructuous.
3. However, liberty may be granted to the petitioner to approach this Court afresh, if any cause of action survives.
4. In view of the above, the WPC(OAC) is disposed of granting liberty as aforesaid.
