1. This matter is taken up through virtual mode.
2. Heard Mr. P.K.Nanda, learned counsel for the Petitioner, and Mr.S.K.Mishra, learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 23rd March, 2021 in connection with Polosara P.S. Case No.13/2020 corresponding to G.R. Case No.15/2020 pending in the court of learned
// 2 // J.M.F.C., Kodala for the alleged commission of the offence under Sections 395 of I.P.C. read with Sections 25 and 27 of the Arms Act.
4. It is alleged that the Petitioner along with four other persons detained the informant along with his driver while they were returning with collection of money in a TATA Magic vehicle and took away cash of Rs.1,70,000/- by showing a mauser.
5. Having regard to the submissions made, the materials on record, the period of detention already undergone and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail.
6. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case, failing which it shall be open to the trial court to pass appropriate adverse order as it may deem fit and proper.
7. The BLAPL is disposed of.
8. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice
