This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
Heard learned counsel for the petitioner and learned Standing Counsel for the School and Mass Education Department.
This writ petition has been filed by the petitioner Dillip Kumar Kar with a prayer for inclusion of his name in the eligibility list of first post peon in Pranabandhu High School, Balanga, Soro in the district of Balasore and for consequential proposal to be submitted before the Government. Learned counsel for the petitioner during course of argument submitted that highlighting his grievances,
// 2 // representation has been submitted by the petitioner before the Director, Secondary Education, Odisha, Bhubaneswar (opposite party no.2) on 30.09.2022 under Annexure-5 for holding an enquiry for such purpose and no order has yet been passed on his representation and therefore, the opposite party no.2 may be directed to dispose of the representation within a time limit.
Mr. Pattajoshi, learned Standing Counsel appearing for the School and Mass Education Department has no serious objection for such prayer.
Considering the submissions made by the learned counsel for the respective parties, without expressing any opinion on the merits of the case, the opposite party no.2 is directed to dispose of the representation of the petitioner under Annexure-5 preferably within a period of four weeks from the date of production of a certified copy of this order along with a copy of the writ petition after giving an opportunity of hearing to all the parties concerned and communicate the result of such exercise to the petitioner within two weeks of taking the decision.
Accordingly, the writ petition stands disposed of. Urgent certified copy of this order be granted on proper application.
