1. This matter is taken up through Video Conferencing mode.

2. Heard learned counsel for the Petitioner and learned counsel for the State.

3. The petitioner has filed this CRLMC with a prayer to set aside the last paragraph of the impugned order dated 04.10.2021 passed by the learned S.D.J.M., Angul in C.M.C. No.170 of 2015 and to direct the learned S.D.J.M., Angul to proceed against the present opposite party no.2-Purna Chandra Mishra in accordance with Section 340 of the Cr.P.C. with immediate effect for alleged commission of offences under Section 196/ 197/ 198/ 199/ 200 of the I.P.C.

4. Having heard from both sides and upon perusal of materials on record, there appears no plausible ground to interfere with the impugned order passed by the learned S.D.J.M., Angul in the aforesaid case, as the trial court has warned the present opposite party no.2 not to file such kind of affidavit in future.

// 2 // However, if any cause of action arises in future, the petitioner may approach the appropriate court.

5. Accordingly, the CRLMC is disposed of.

6. As the restrictions due to resurgence of Covid-19 are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the Advocate concerned with his/her seal, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020 and Court's Office Order dated 7th January, 2022.
