This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is the fourth successive writ application of the petitioner. The last writ application of the petitioner in W.P.(C) No.15001 of 2022 was disposed of as per order dated 14.07.2022 and this Court directed the Sub-Collector, Puri (opp. Party no.2) to consider the representation of the petitioner stated to have been submitted on 19.05.2022.

This matter relates to selection of Anganwadi

// 2 // worker in respect of Tangibhasar Anganwadi Centre which was made in the year 2010.

It is stated that the opposite party no.4 Kaberi Badajena @ Nayak of the writ petition No.15001 of 2022, who was working as the Anganwadi worker of the said Anganwadi centre on the basis of her selection made in the year 2010 has tendered her resignation on 30.04.2022 and fresh advertisement has been issued on 03.11.2022. The claim of the petitioner that since she was number-two in the select list prepared in the year 2010 pursuant to the advertisement made in the year 2009, in place of Kaberi Badjena @ Naik, her case should be taken into consideration.

I am not inclined to accept such contention made by the learned counsel for the Petitioner. A panel of selected candidates cannot be valid for indefinite period. A select list cannot be treated as a reservoir for the purpose of appointments, that vacancy can be filled up taking the names from that list as and when it is so required. Empanelled candidates in any event cannot have a right against future vacancies. The Petitioner is at liberty to apply for the post. If she fulfils the eligibility criteria, her case will be considered along with the other applicants in accordance with law.

Accordingly, the writ petition is disposed of.
