2. 1. When the matter was last taken up on 13.10.2022, the following order was passed :

"2. The writ petition has been registered before this Court on 20.01.2022 after the Original Application was transferred from the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack upon abolition.

3. On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was presented on 31.10.2017 and notice of admission were issued on 05.01.2018 directing to file counter within four weeks and rejoinder was to be filed within two weeks thereafter.

However, the matter was not taken up/pursued thereafter.

4. Mr. Satpathy, learned counsel for the petitioner appearing through V.C. submits that he has not been provided copy of the counter.

5. Learned Addl. Govt. Advocate submits that copy of the affidavit is available. Learned counsel for the petitioner may collect the same right now in the Court.

6. Accordingly, learned counsel for the petitioner shall make it convenient to collect the copy of the counter today.

7. As prayed for by the learned counsel for the petitioner, list on 17th November, 2022.

8. The petitioner shall have the liberty to file rejoinder, if so advised."

2. Learned Additional Government Advocate referring to the counter submits that nothing survives for adjudication at present in the present petition.

3. Learned counsel for the petitioner submits that he has no up-to-date instructions from the petitioner to pursue the matter at present.

4. Having heard the learned counsel for the parties, the writ petition is disposed of granting liberty to the petitioner to revive the same within sixty days. ( M.S.Sahoo) Judge Gs
