This Writ Petition involves two faceted prayers. One there is a notice directing the Petitioner to stop supply of water through tanker vide Annexure-6. At the same time Petitioner also challenges the inaction of the competent authority in not releasing the hire charges involving use of the mobile tanker for supply of the water in the locality.

Keeping in view the submission, this Court considering the first prayer finds, the Gram Panchayat has given a notice to the Petitioner to stop supply of water through tankers at least within a period of seven days from the date of receipt of the notice. The notice was issued on 17.06.2022. There is long lapse of time and almost nearly five months have already passed in the meantime. Undisputedly supply of water through Tankers of the Petitioner is stopped long since. This Court, therefore, declines to entertain request of the Petitioner so far it relates to interfering in the notice

So far as the prayer number 2 is concerned, this Court directs, in the event any such application at the instance of the Petitioner is still pending, the Petitioner is at liberty to approach the Sarpanch of the particular Gram Panchayat for release of the same. This Court here notices, the Petitioner has already made an approach to the Sarapanch of the Gram Panchayat vide Annexure-5. This Court directs, in the event such application is still pending, there should be a lawful disposal of the same and provision may be made for release of the admitted entitlement, if any, involving the Petitioner within appropriate time. In the event the Petitioner has any further claim, he may supplement his claim involving Annexure-5 before the concerned Sarpanch at least within a period of seven days hence.
