This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under section 439 of Cr.P.C. for grant of bail to the petitioners in connection with Kodala P.S. Case No.646 of 2021 corresponding to G.R. Case No.1658 of 2021 pending before the learned J.M.F.C., Khallikote for alleged commission of offences under section 394 of the Indian Penal Code read with sections 25(1-B)(a)/27 of the Arms Act.

The petitioners moved an application for bail before the Court of Additional Sessions Judge, Khallikote, which was

// 2 // rejected on 14.11.2022.

Learned counsel for the petitioners submitted that though the case is of the year 2021 but the petitioners were taken into judicial custody in connection with this case on 01.11.2022 and except the confessional statement of the petitioners before the police, there is no other material against them and therefore, the bail application of the petitioners may be favourably considered.

Learned counsel for the State opposed the prayer for bail.

Considering the submissions made by the learned counsel for the respective parties, the nature of accusation against the petitioners and taking into account the period of detention of the petitioners in judicial custody, I am inclined to release the petitioners on bail.

Let the petitioners be released on bail in the aforesaid case on furnishing bail bond of Rs.50,000/-(rupees twenty thousand) each with two local solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with such other conditions as the learned Court may deem just and proper.

BLAPL is accordingly disposed of.

Issue urgent certified copy as per Rules.
