This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

The present writ petition has been filed by the Petitioner with a prayer to direct the Opposite Parties to pay the salary of the Petitioner with effect from his initial date of appointment as NMR and quash the orders under Annexures-3 and 4. 3.

Learned counsel for the Petitioner relies upon the order passed by the Orissa Administrative Tribunal, Cuttack Bench in O.A. No.694 (C) of 2011 on 11.04.2012. He further submits that the case of the Petitioner is squarely covers by the decision of the Tribunal in the aforesaid Original Application. It is further submitted that a batch of cases were disposed of by a common order by the Tribunal.

In such view of the matter, this Court disposes of the present writ petition with a direction to the Competent Authority to consider the case of the Petitioner in the light of the order of the Tribunal

// 2 // dated 11.04.2012, passed in O.A. No.694(C) of 2011 within a period of three months from the date of production of certified copy of this order as well as order dated 11.04.2012.

With the aforesaid observation, the writ petition stands disposed of.
