Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.2362 of 2019, on the files of learned J.M.F.C.(R) Cuttack, arising out of Sadar P.S. Case No.555 of 2020, U/s.302/34 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Court of Sessions Judge, Cuttack by order dated 14.12.2020 in G.R. Case No.2362 of 2019, arising out of Sadar P.S. Case No.555 of 2020, the present BLAPL has been filed.

Taking into account the order passed by this Court dated 07.09.2021 in respect of co-accused Muna Khan in BLAPL No.9188 of 2020 and the statement of one Sri Suresh

// 2 // Sahoo @ Bubun, this Court is not inclined to consider the application for bail at this stage. It shall be open to the petitioner to move at later stage, if so advised.

Accordingly the BLAPL stands dismissed.
