Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to issue appointment order in his favour as initial appointee in the post of Physical Education Teacher, in the vacant post meant for ST (W) pursuant to advertisement dated 30.12.2021 under Annexure-1 after de-reserving the said post as per Orissa Reservation of Vacancies in Posts and Services (for Scheduled Castes and Scheduled Tribes) Rules, 1976, since the petitioner was duly selected in the recruitment process and his name finds place in the merit list under Annexure-3. 4.
In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to opposite party no.1 vide Annexure-5 and the same may be directed to be considered and disposed
of taking into consideration Annexure-4 within a stipulated time, to which learned State Counsel has raised no objection. 5.
As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.1 to consider the representation filed by the petitioner vide Annexure-5 and pass appropriate order in accordance with law taking into consideration Annexure-4 within a period of three months from the date of production of certified copy this order.
