This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners who are the Managing

// 2 // Committee of Daitari High School, At- Koilisahi in the district of Balasore and its Secretary have filed this writ petition, inter alia, with a prayer to dispose of the representation dated 17.09.2022 pending before the Commissioner-cum-Secretary, School and Mass Education Department, Secretariate Building, Bhubaneswar opposite party no.1 to bring the school in question within the fold of Grant-in-Aid.

Learned counsel for the State has pointed out that section 24-B of the Orissa Education Act, 1969 empowers the Educational Tribunal to deal with such matter.

In view of such provision, since an alternative remedy is available to the petitioners, the learned counsel for the petitioners seeks permission of this Court to withdraw this writ petition in order to approach the appropriate authority.

Accordingly, the writ petition is disposed of giving liberty to the petitioners to approach the appropriate authority.

Issue urgent certified copy as per Rules.
