Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking to quash the order of re-fixation of pay/recovery dated 31.08.2016 under Annexure-4 and further to issue direction to the opposite parties to finalize the pension as per the earlier pay fixation order dated 31.12.2013 under Annexure2 and release arrears of pension and pensionary benefits after refixation of pay with 18% interest till date of payment and release his gratuity with 7% interest from the date of eligibility till the date of payment.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to opposite party no.3 vide Annexure-7 series and the same may be directed to be considered within a stipulated time, to which learned State Counsel has no objection.

As agreed by the learned counsel for the parties, this Court, without expressing any opinion on the merits of the
case, disposes of the writ petition directing opposite party no.3 to consider the representation filed by the petitioner vide Annexure-7 series and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order. 6.
Issue urgent certified copy as per rules.
