Mr. A.K. Sarangi, learned counsel for the petitioner states that though the petitioner is in occupation of personal land, but the opposite parties are taking steps for eviction. 4.

Mr. S. Nayak, learned Addl. Standing Counsel appearing for the State-Opposite Parties states that if the petitioner is in possession of its personal land, question of eviction does not arise. If at all the authority is taking steps for eviction, liberty may be granted to the petitioner to pursue its remedy before the appropriate forum in accordance with law.

In view of the above, since the petitioner is in possession of personal land and the opposite parties are taking steps for eviction, liberty is granted to the petitioner to approach the appropriate common law forum ventilating its grievance in accordance with law. 6.
