Heard Mr. P.K.Satapathy, learned counsel for the Petitioner and Mr. Y.S.P.Babu, learned Addl. Government Advocate for the State- Opposite Parties.

Even though the present Writ Petition has been filed challenging the office order dated 18.10.2017 passed by Opposite Party No.2 under Annexure-5, but Mr. Satapathy, learned counsel for the Petitioner submitted that the Petitioner in fact relies on the said order as persons similarly situated have been brought over to the work charged establishment vide the said order ignoring the case of the Petitioner.

In that view of the matter, this Court while disposing the Writ Petition permits the Petitioner to make a fresh representation before Opposite Party No.2 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of two (2) weeks hence.

It is observed that if such a representation is filed within the aforesaid period, the Opposite Party No.2 shall do well to dispose of the representation in accordance with law within a period of 2 (two) months. The decision so taken by the Opposite Party No.2 be communicated to the Petitioner within that time.

It is observed that while considering the claim of the petitioner, the benefit extended in favour of similarly situated NMR vide order dated 18.10.2017 be taken into consideration by the said opposite party. If it is found that the Petitioner is similarly situated, necessary order in his favour be passed. The entire exercise shall be completed within a period of three months.

With the aforesaid observations and directions, the WPC(OAC) stands disposed of.
