The petitioner has filed this writ petition seeking direction to the opposite parties to give him promotion from Group-D post to Group-C post (Junior Clerk), as vacancies available under the administrative control of opposite party no.4-District Education Officer, Balasore and further to issue direction to the opposite parties to grant service benefits pursuant to such promotion.

Opposite party no.3 has filed counter affidavit, wherein it is stated that the Collector, Balasore had called for the names of the Class-IV employees having qualification of HSC in his letter dated 16.12.2011. In compliance of the same, names of eligible candidates including the name of the petitioner have been submitted, but no order has yet been passed with regard to promotion of Group-D employees to Group-C employees. As such, opposite party no.4 has not got any instruction either from the Government or from the Collector, Balasore with regard to such promotion. 4.
In that view of the matter, as and when occasion arises for promotion, opposite party no.4 will consider the
grievance of the petitioner and pass order in accordance with law.

With the above observation, the writ petition stands disposed of.
