None appears for the Petitioner. Heard Mr. A.K. Mishra, learned Additional Government Advocate for the State. Perused the record.

The Petitioner has filed this Writ petition seeking to quash the order under Annexure-8 passed by the Special Officer to Government of Odisha, MSME Department, addressed to the Director of Industries, Odisha, Cuttack, by which direction was given to take steps for removal/disengagement of the petitioner ExIPO from official duty by adopting the special procedure of Rule 18 of OCS (CCA) Rules, 1962 till the Petitioner is absolved from the charges by Appellate Court.

Mr. A.K. Mishra, learned Additional Government Advocate referring to the preliminary counter affidavit contended that by order No. 11611 dated 04.12.2017 the Director of Industries has dismissed the Petitioner from Government service in terms of Rule 13 red with Rule 18 (1) of the OCS (CCA) Rules.

In view of the above, since the order of dismissal has already been passed, nothing more remains to be adjudicated in this writ petition. It is open to the petitioner to challenge such dismissal order, if he is so advised.
