This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). Heard the learned counsel for the petitioner and learned counsel for the State.
This is an application for bail under section 439 of Cr.P.C. in connection with Mathili P.S. Case No. 42 of 2021 corresponding to Special G.R. Case No. 36 of 2021 pending in the Court of learned Sessions Judge - cum- Special Judge, Malkangiri for alleged commission of offence under section 20(b)(ii)(C) of the N.D.P.S. Act.
The prayer for bail of the petitioner has been rejected by the learned Sessions Judge -cum- Special Judge, Malkangiri by order dated 08.03.2021.
// 2 // In view of the commercial quantity of ganja seized from the possession of the petitioner and the bar under section 37 of the N.D.P.S. Act, while not inclining to release the petitioner on bail, I direct the learned trial Court to expedite the trial and take steps for examination of the material witnesses at the first instance. The petitioner is at liberty to renew his prayer for bail after examination of the material witnesses in the trial Court.
The BLAPL is accordingly disposed of.
