2. Heard learned counsel for the Petitioner.
3. The present Writ Petition has been filed with the following prayer:
"Allow the Writ Petiton by declaring ultra virus of struck down the said classification in respect of the Point No.6 i.e. "Since the ET qualification is not equivalent to CT/B.Ed. teachers of Level-V having ET qualification are not eligible for promotion in the Elementary Cadre" under Annexures-4 & 5 and direct the respondents to include the primary teachers having ET qualification in the Gradation List prepared for Leve-V Teachers in its correct position as per seniority."

Taking into account the submissions made, the Petitioner is permitted to make fresh representation before Opp. party No.1 in that regard within a period of one week from today.

It is observed that if any such representation is filed by the Petitioner ventilating his grievances, the
// 2 // same shall be considered by Opp. party No.1 in accordance with law within a period of one month from the date of receipt of such representation.

It is observed that while considering the claim of the petitioner, the said Opp. party No.1 shall take into consideration the order passed by this Court on 23.12.2012 in W.P.(C ) No.14979 of 2010.

With the aforesaid observation and direction, the Writ Petition is disposed of.
