This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner as well learned Addl. Government Advocate for the State of Odisha In this writ petition, the petitioner Chumki Deep has challenged the inaction of the opposite parties in not providing opportunity to object to the candidatures of some applicants pursuant to the notice under Annexure-4 and consider the same before making any appointments relating to the advertisement under Annexure-1 for

// 2 // Kutmenda-1 Anganwadi Centre.

It is the contention of the learned counsel for the petitioner that opposite party no.4 Child Development Project Officer, Ulunda issued advertisement on 18.10.2022 inviting applications from intending women candidates for their engagements as Anganwadi Workers in respect of two Anganwadi Centers, namely, Kutmenda1 Anganwadi Centre under Village Chadhaipanka and Kalapathara-1 Anganwadi Centre under Village Kalapathara and the petitioner being an eligible candidate submitted her application in prescribed form with all required documents for being engaged as Anganwadi Worker in respect of Kutmenda-1 Anganwadi Centre. The opposite party No.4 issued a public notice after scrutinizing the applications of all the applicants i.e., if there is any objection against the candidates, the same can be raised within seven days of time frame i.e., 04.11.2022 to 10.11.2022 on the Website- through Online mode.

It is the contention of learned counsel for the petitioner after issuance of such public notice, the petitioner could not able to register any such objection on the Website for some unknown reasons and then she approached the opposite party no.3 to register her objection in the Offline mode but opposite party no.3 instructed her that objections could be raised only on Online mode and refused to accept her objection. In this writ petition, there is nothing that against whose candidature and on what ground the petitioner was intending to raise objection and even the objection copy

// 3 // has not been annexed to the writ petition.

Learned counsel for the petitioner submitted that since the selection process is not yet over, the petitioner may be permitted to file a representation before the concerned authority highlighting the objection about the candidature of some candidates on some specific grounds. Learned counsel for the State submitted that it is not known whether the selection process is over or not. Be that as it may, if the selection process is not yet over and the petitioner files a written objection before the opposite party no.4 Child Development Project Officer, Ulunda, Subarnapur along with a copy of this order by day after tomorrow (09.12.2022), the same shall be accepted and considered by the opposite party no.4 in accordance with law.

Accordingly, this writ petition is disposed of. Issue urgent certified copy as per Rules in course of the day.
