This matter is taken up through hybrid mode.

The writ petition has been registered before this Court on 24.1.2022 after the Original Application was transferred from the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition. 3.

On perusal of the available order sheets of the learned Tribunal, it is indicated that notices on admission were issued on 09.02.2018 directing to file counter within four weeks and rejoinder was to be filed within two weeks thereafter. In the interim, the Tribunal directed as follows:- "So far as prayer for interim prayer is concerned, it is made clear that during pendency of the O.A. there is no bar for the authority to consider the representation of the applicant dt.5.7.2017 at Annexure-7."

The matter was never taken up/pursued thereafter.

Learned Addl. Govt. Advocate referring to the communication received from the Director, Export Promotion and Marketing (Opp. Party No.2) by Memo No.4769 dated 29.06.2018 received in the office of the Govt. Advocate, OAT, submits that since the Annexure4 enclosed to the petition is doubted for its authenticity as per the report of the Tahasildar, the petitioner is not to be shown any further indulgence as far as the present writ petition is concerned. Copy of the said communication along with enclosures are kept on record.

Having heard the learned Addl. Govt. Advocate , the writ petition is dismissed.
