This matter is taken up through hybrid arrangement (virtual/ physical) mode.

The Petitioner having been implicated in connection with Nayapalli P.S. Case No.513 of 2021 corresponding to C.T. Case No.6120 of 2021 pending on the file of learned S.D.J.M., Bhubaneswar running for the alleged commission of offence under section-147/148/506/341/323/294/384/385/149/120-B of the IPC read with Section-25/27/35 of the Arms Act and Section-7 of the Criminal Law (Amendment) Act, has filed this application under section-438 of Cr.P.C. for his grant of anticipatory bail in the event of his arrest in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made and on going through the nature of accusations as those emanate from the materials on record;

further keeping in view the other surrounding circumstances; while being not inclined to entertain this application is disposed of with the observation that in the event the Petitioner surrenders before the Court in seisin of the aforesaid case and moves for his release on bail, the same shall be considered on its own merit; further taking into account the factum of release of co-

// 2 // accused person(s) on bail, if similarly situated with the Petitioner on the ground of parity as per law and disposed of early in accordance with law.

The ABLAPL is accordingly dismissed.
