1.This matter is taken up through hybrid mode.

2. Heard.

3. The petitioner is in jail custody in connection with Orkel P.S. Case No. 132 of 2019 arising out of T.R. Case No. 100 of 2019 now pending in the court of learned Addl. Sessions Judge-cum-Special Judge, Malkangiri for the punishable offence under Section 20(b) (ii) (C)/ 27-A/ 29 of NDPS Act.

4. Pursuant to the order dated 07.04.2022 of this Court with regard to submission of status report in T.R. Case No. 100 of 2019 a letter has been received from the learned Addl.

Sessions Judge-cum-Special Judge,

// 2 // Malkangiri, wherein he has been mentioned that out of 18 charge sheeted witnesses 6 have already been examined and now the case has been fixed to 18.05.2022 for hearing summons & messages have been issued to the concerned P.S. to procure the attendance of the remaining charge sheeted witnesses.

5. In view of the matter, this Court is not inclined to allow the prayer for bail, accordingly BLAPL stands dismissed.

6. However, it is mate clear that for the trial is not concluded within a stipulated period the petitioner is at liberty to file fresh application for bail before this Court.

5. Accordingly, this BLAPL is disposed of.

6. Urgent certified copy of this order be granted on proper application.
